This data protection and cookie information applies to the processing of personal data (hereinafter also referred to as “data”) within the framework of our website de.loomis.com. Our data protection and cookie information and our responsibility and liability relating to this do not, in principle, extend to websites operated by third parties, which are linked to our website or to which you are redirected. As a result, we are not responsible either for data processing carried out in these cases by the operators of these websites.

3. Purposes of the data processing, legal basis for the processing


We take the protection of your personal data very seriously. We always process your data in accordance with the statutory provisions. It is in principle possible to use our website without having to provide personal data.

If you would like to contact us via the contact form available on our website or send us a job application, we have to process your personal data. If you use a form provided on our website, we will process your data within the limits of the data you enter in the respective fields of the form. The following personal data may be processed when you use our contact form: interest in a particular service, company name, first name, surname, address, email, telephone number, details provided in the enquiry message. This data is processed for the purpose of initiating or concluding a contractual relationship (Art 6 para 1 lit b GDPR) and on the basis of our legitimate interests in our accessibility for interested parties and business partners and communication with them (Art 6 para 1 lit f GDPR). This personal data is not passed on to third parties in a function as independent data protection officers.

4. Storage period


We will only store your data for the period required to achieve the purpose for which the data are stored. This period will in principle be three years following your last contact with us, as we assume that you are interested in our product information until this time. We store data which are relevant for accounting for a period of ten years. Data which are necessary for the establishment, exercise or defence of legal claims against a public authority may be stored in cases of dispute until the matter has finally been settled. We record general data and information every time you visit our website. These general data and this general information are stored in the log files of the server. The processing is neither legally nor contractually required (Art 13 para 2 lit e GDPR).


6. Data processing of applicants


We process your personal data either
  • - to carry out pre-contractual measures (conclusion of a service contract, Art 6 para 1 lit b GDPR),
  • - based on your explicit consent (Art 6 Abs 1 lit a GDPR), if we are allowed to keep you on record as an applicant,
  • - to fulfill our legal obligations (registration as an employee with the social insurance, Art 6 Abs 1 lit c GDPR).


The processing of your data serves the purpose of handling the application procedure and registration with the social security if we hire you; if we do not hire you and you agree, the processing serves the purpose of keeping your data on record for contacting you if a position suitable for you becomes available in the future. If you do not provide us with your data, we will not be able to process your application.
In order to achieve these intended purposes, it may be necessary on a case-by-case basis for us to disclose your data to the following recipients. This disclosure may be by transmission, dissemination or other form of provision.

7. Your rights in pursuance of the GDPR


The GDPR gives you the following rights:

Right of access: You shall have the right to obtain from us confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, access to the personal data.

Right to rectification: If the personal data concerning you and processed by us are incomplete or inaccurate, you may obtain from us rectification of the data, or require us to complete incomplete data, at any time.

Right to erasure: You shall have the right, under the requirements of Art 17 GDPR, to obtain from us the erasure of personal data concerning you, in particular if you are of the opinion that the data are no longer necessary in relation to the purposes for which they were collected or processed; that we are processing them unlawfully; or that the legal basis for the processing has lapsed. However, we would like to draw your attention to the fact that there may be grounds which oppose immediate erasure, for instance if we are legally obliged to store certain data.

Right to restriction of processing: You may obtain from us restriction of processing of your data in the following cases:

  • - if you contest the accuracy of the data, for a period enabling us to verify the accuracy of the data;
  • - if the processing of the data is unlawful and you oppose the erasure and request the restriction of the use of the data instead;
  • - if we no longer need the data for the intended purpose, but you still require the data for the establishment or defence of legal claims, or
  • - if you have objected to the processing of the data.



Right to data portability: You shall have the right to receive the data concerning you in a structured, commonly used and machine-readable format, where:

  • - we are processing this data based on consent given by you or for a legitimate interest, or the processing is required to fulfil the contract between us; and
  • - the processing of your data is carried out by automated means.



Right to object: In cases in which we base our data processing on our legitimate interest, you may object, on grounds relating to your particular situation, at any time to this data processing. However, we would like to draw your attention to the fact that we are entitled to continue processing the data, despite your objection, if we can demonstrate compelling grounds worthy of protection for the processing, which override your interests, rights and freedoms, or if the processing is used for the establishment, exercise or defence of legal claims.

Right to withdraw consent: If we process data on the basis of consent given by you, you shall have the right to withdraw this consent at any time with effect for the future.

8. Right to lodge a complaint


If you are of the opinion that we are infringing German or European data protection law during the processing of data relating to you, we would ask you to contact us, in order to be able to resolve any issues. You do of course also have the right to lodge a complaint with the supervisory authority (that is the Data Protection Authority in Germany).
